These standards are utilized in the legal disputes. In the United States, basic laws are utilized to ensure equal result for similar cases. The higher court could settle on a choice on a case and the lower court must follow that decision. On the off chance that the court finds a case not quite the same as past cases heard by different courts, its decision is probably going to construct point of reference for future cases on that theme. The term custom-based law was first authored in the twelfth century during the matchless quality of Henry II of England. The recently shaped normal conditions of America followed their own types of precedent-based law, disengage from the other government law. The government courts of the nation utilize the customary law when choosing administrative cases. Now and again, government court may hear a case under the state law. One of the significant corrections is the Consolidated Omnibus spending Reconciliation Act (COBRA). It permits a f ew laborers and their family to get the appropriate for proceeding with their wellbeing inclusion temporarily after specific occasions. A further significant alteration is the Health protection Portability and Accountability Act (HIPAA) that gives new security to the working Americans and their families. Nonetheless, ERISA doesn't give the gathering wellbeing plan. States can in a roundabout way manage the medicinal services plans, which give the advantages through protection contracts. It likewise fund-raises by forcing premium assessments. Be that as it may, they can't do something very similar with self-financed plans. State guideline of the representative advantages can mess three up, for example, cost of duties, cost of managing considerable and the expense of recognizing. According to the law, the court concluded that any individual couldn't recoup any harms as he has endured by unjust disavowal. In addition, it doesn't cover corrective harms. In this way, it very well may be surveyed that throughout the years, ERISA has become less worker neighborly. 4. Tort change proposition first proposition The majority of the individuals don't know whether they are pertinent for guaranteeing the advantages. In addition, they don't mindful of their assurance. The briefly incapacitated individuals need their doctor's visit expenses and other injury related costs. The tort framework really deferred the arrangement of giving advantages to the person in question. If there should arise an occurrence of high sum, the tort framework sets aside long effort to explore the episode and from that point onward, the casualty gets the advantage. Accordingly, it is a long procedure. It is proposed to ensnare exchange off that would diminish about all transient incapacity cases from the tort framework. Be that as it may, the exchange off would be a troublesome undertaking, as it would be founded on the commonplace game plans that numerous representative as of now have. second proposition Numerous individuals can't work because of their inability. It makes them denied of doing ordinary action in every day life. Numerous individuals have been experiencing genuine and changeless hindrance or distortion. In this way, it is proposed to reshaping the tort law so those individuals could undoubtedly get the pay. Through the commitment of reshaping the remuneration framework, the tort framework could offer better help to the people in question. The advanced pay must be join in every division of the tort framework. By and by, an exchange is proposed to improve casualties and respondents off. In the cutting edge remuneration arrangement, the casualties ought not give the enormous measure of their advantage to the legal counselors. Accordingly, the tort litigants are required to pay fruitful tort offended parties sensible legitimate expenses. Theodore Roosevelt My Legacy Leader essayEssay Writing Service

Theodore Roosevelt My Legacy Leader essayEssay Writing Service Theodore Roosevelt My Legacy Leader essay Theodore Roosevelt My Legacy Leader essayLeadership is crucial for the military as well as politicians. At the same time, leadership is not just the innate quality but it is also the acquired set of skills and abilities, which leaders develop in the course of their personal and professional development. Leadership is particularly important for the military as well as for politicians because they have to perform roles of leaders in the course of their career to reach success. Moreover, leadership is not only a strong element of the professional development of the military and politicians but also a part of their responsibility because the military have to lead soldiers into the battle and help them to reach their unit’s tasks, while politicians also have to be leaders since they represent a large number of people, who vote for them and whose interests they serve. In this regard, I believe that I can also succeed as the military and politician due to my leadership skills and abi lities. At the same time, I believe Theodore Roosevelt was the prominent leader, whose experience is worth studying and whose way is worth following, because he was a prominent and successful leader, who was close to his people and who had charisma that made many people following his lead. However, what makes Theodore Roosevelt particularly important for me as a leader model is his proximity to his people since he seemed to be just one of his soldiers, when he was in the military, and he was just like a guy living next door, when he was the President of the US. In this regard, the legacy of Theodore Roosevelt proves the full extent to which effective leadership is important in both the military and politics because, as the military, he united cowboys and led his guys into the Spanish-American war as the true military leader, and he enhanced the position of the US as the world power as the political leader of the country. This is why I believe leadership is the key to the professiona l success and effective performance in the field of the military and politics. The importance of leadership in the military and politics reveals the close interrelatedness between these two fields. To put it more precisely, as the experience of Theodore Roosevelt shows, the army is an essential component of any state and a state cannot be strong and successful without the army. At the same time, a strong army cannot exist in a state, where there are no strong, charismatic and reasonable leaders. They can develop the successful policy that makes the state stronger, while the army relies on wise state policies and enhances the state through its deployment to protect national interests. The army is the core of any state but the effective and successful army can exist only on the condition of soldiers and officers, who can serve to their nation and stand for national interests of the state and its people. Professionals serving in the army, especially those, who want to become leaders, hav e to be aware of key competences and features that army leaders should match as well as all professionals serving in the army should. At this point, it is possible to refer to the army’s 3Cs, which include character, competence, and commitment. These features are crucial for soldiers and officers because they comprise the core of a true military. The character implies that an army professional’s dedication and adherence to the Army values, virtues, purpose, identity, ethics, and morals as consistently and faithfully demonstrated in decisions and actions. The respect and adherence to the army values, virtues, purpose, identity, ethics and morals are crucial for professionals working in the military because they should be aware of the background of the organization, where they work and stick to its system of values. Otherwise, there is no room for professionals, who disregard the traditional set of values of the US army. The successful military leadership starts with unde rstanding the army’s set of values, its character and adherence to those values. The leader should not only manifest respect and understanding of those values but also personify them to make soldiers following his/her lead. The competence means that an army professional’s demonstrated ability to successfully perform their duties and to accomplish the mission with discipline and to standard. Professionals working in the army should be able to perform their duties perfectly, especially leaders. Discipline and fulfillment of duties are primary concerns of soldiers and officers because they are crucial for the army. In fact, discipline and fulfillment of duties determine, whether the army can perform its military tasks successfully or not (Hendrix, 2009). The lack of discipline or poor fulfillment of professional duties by the military can lead to the failure of military operations and undermine the effectiveness of the army. On the contrary, the ability of the army and pro fessionals working in the army to stick to the strict discipline and fulfillment of their duties makes the army, which is properly equipped and supplied, virtually undefeatable. The commitment implies that the resolve of army professionals to contribute Honorable Service to the Nation, to perform their duties with discipline and to standards, and to strive to successfully and ethically accomplish the mission despite adversity, obstacles, and challenge. The commitment is essential for the successful development of a leader in the military environment. More important, the commitment can contribute to the development of the successful political career. The rise of the political leader committed to his or her nation is one of the essential conditions of the popularity of the leader among people. People adore leaders committed to nation and traditional American values, as was the case of Theodore Roosevelt, for example, who manifested his commitment to the US and traditional American valu es. This is why his people adored him as the military leader and Americans liked him as the political leader of the nation.Theodore Roosevelt is my leader of influence, whose attributes and competencies contributed to the military and the community consistently. He was a charismatic leader, who stuck closely to traditional American values. Even though, in some respects, his traditionalism was excessive. For example, he was renowned for his robust masculinity but, in his time, this was a distinct feature of the leader and male domination was traditional in the US in the late 19th – early 20th century (Rofe, 2008). At the same time, he was a charismatic leader with a strong will. For example, he grew as a weak child, who suffered from asthma. However, in spite of his serious health problems, he focused on his physical development. For example, he practiced boxing at Harvard. In addition, he was ambidextrous and proficient in different fields, from biology to history. In such a way, a true leader cannot be skilled in one field only, like the military, for example. Instead, the leader should be like Theodore Roosevelt, proficient in different fields and be physically and intellectually well-developed.At this point, the development of my leader of influence contributed to his personal growth and development as a soldier and leader (Ricard, 2006). For example, his strong will and physical training, along with his habit to overcome difficulties and challenges, have proved to be very useful for his personal growth and development as a soldier and leader. Moreover, he was a true patriot of the US, who loved his fatherland and believed that the US should play the leading part in the region. This is why he headed his regiment of cowboys in the Spanish American war, while his activities and wins in Cuba had brought him the national approval and recognition.Furthermore, he had proved to be a true leader, who was recognized and followed blindly by his soldiers (Holme s, 2006). His soldiers really liked him and they were ready to follow his lead, even when operations conducted by Roosevelt were risky. Moreover, it was Roosevelt, who persuaded them to join him and take part in the Spanish American war. Roosevelt was also the leader, who had managed to unite western and eastern cowboys. The legacy that I would like to leave is similar to the legacy of Theodore Roosevelt. Americans liked him and ignored his pitfalls. The legacy that I want to leave is one that can effectively and positively affect the lives of the soldiers that serve under me and my family. I would like soldiers under my lead to follow me blindly and believe in every move that I make without hesitation so that I could rely on my soldiers and conduct military operations under my lead and responsibility (Oyos, 2011).   At the same time, I would also like to be a leader, whom soldiers remember and like. Moreover, I would also like to be a leader, who establishes the family environment within his military unit, when each soldier treats each other as family members and are ready to die for each other.   At the same time, I believe that the true military leader keeps growing not only professionally but also personally. For example, while serving in the military I have become a better father and husband and that by being a father and husband I am a better soldier. Thus, leadership is crucial for military and political leaders. At this point, it is possible to refer to the example of Theodore Roosevelt, who was the true leader of the army and the entire nation. His soldiers perceived him like a father, while the nation perceived him as a true national leader, who stood for national interests of the US and stuck to traditional American values. This is why I would like to be similar to Theodore Roosevelt as the military and political leader. His legacy is worth studying and his leadership model is worth following. As for me, I expect to have the similar legacy and I w ould like my soldiers liked me and treated me like a father.

Aristotle s Philosophy On Ethics Essay -- Ethics, Philosophy, Categoric

Aristotle is a strong believer that reaching happiness is the ultimate goal of humans. He says, â€Å"Another belief which harmonizes with our account is that the happy man lives well and does well; for we have practically defined happiness as a sort of good life and good action. The characteristics that are looked for in happiness seem also, all of them, to belong to what we have defined happiness as being† (Aristotle, Book I). Aristotle claims that a happy person lives well and that is what we should be striving for. We reach this happiness by doing good actions and it can take an entire lifetime to become virtuous. He also relates good actions to doing an activity well. Doing an activity well is important because after mastering an art you feel good about yourself or happy. For example, if you are a potter and you make a great pot, you feel happy. Kant poses the complete opposite of Aristotle’s philosophy and disregards happiness with being moral. Kant does not believe reaching happiness is the main goal of life, but instead doing good with a sense of duty is. Kant says, â€Å"A good will is good not because of what it effects or accomplishes†¦ it is good only throug... ... middle of paper ... ...nted to spread the knowledge, they are acting out of inclination instead of from duty. Aristotle and Kant propose very different philosophies. Aristotle is concerned with reaching happiness as to become a virtuous person. We are happy by doing good actions and mastering certain tasks. But happiness should not be the goal of humans to be virtuous because it possesses too many flaws as to what happiness really is. Kant offers a more concrete philosophy to being virtuous. He believes in following categorical imperatives or universal laws to doing what right. Doing right comes from a duty to do right and not from an inclination or desire to right. Since Kant exhibits a more concrete philosophy as to why do good, it would work a lot better in an ideal world. It would be very difficult for both philosophies to work in the real world because many questions can be raised.

Evidence Based Practice- Annotated bibliography

Evidence Based Practice- - Annotated Bibliography Example cle would be highly useful for the current research that covers evidence based practice due to the applicability and relevance of the contents in the information gathered, analyzed and from the output generated. Several limitations were noted in the research: the limited number of emergency departments used for the study and the violence noted were primarily recorded from patients and does not include other visitors of the emergency departments. The conclusions emphasized the need for nurses to report violence in their work setting as instrumental in providing policies and preventive measures for these incidents. The article would be highly beneficial for researches in violence met by nurses in the emergency departments’ settings but should include other sources to address the limitations noted. The article focused on exploring patient-related violence directed at nurses through verbal and physical abuse, particularly in emergency departments of various health care institutions. Secondary authoritative sources from databases, CINAHL, Medline, and Journals@ Ovid were used to determine the extent of reporting on patient-related violence noted during a ten-year period 1998 to 2008. The authors’ scope of research covered 53 different papers where studies were conducted in different countries such as Australia, Sweden, Hong Kong, USA, Canada, UK, and Ireland. The article is useful for the current research covering evidence based practice due to the extensive scope, comprehensiveness, and applicability of findings due to the recent publication of findings by the authors. The only perceived limitation of the study is its focus on identified patient-related violence in abovementioned locations which could further be expanded to other work-related settings. The relevance of t he findings indicates the need to address patient-related violence to enhance awareness for policymakers and health care administrators in incorporating preventive measures to safeguard the welfare

Compare and contrast Research Paper Example | Topics and Well Written Essays - 1250 words

Compare and contrast - Research Paper Example Consequently, the two stories may present a conflict that exists between two parties but also express some differences in the cause, plot, setting, and resolution of the existing conflict. Plot and Themes In the story, ‘punishment’, the theme that is brought out in terms of multifaceted human interrelations and behaviors is the theme of women oppression. The author aims at enlightening the position of women in the society in relation to social issues and the sacrifices they have to take to put the point to the society. The two women puts it clearly in the storyline that they are against their husbands commands on their life. The storyline seeks to open the women’s eyes to freedom from oppressive men regardless of the price whereby Chandara is determined to die rather than marrying a man the she knew would have authority of her life. Furthermore, the two women, Radha and Chandara, have a fierce relationships and the author indicates that the two spent most of their time fighting despite their close family relationship ties. Surprisingly, Dukhiram kills his wife Radha after a quarrel but the information given to the authorities is very different whereby the brother to Dukhiram inflicts his wife Chandara as the suspect in favor of his bother. This instance further reveal the complex relation s that the two men and their women. The story ends with Chandara being found guilty of an offence not committed but could not defend herself against her husband because of the oppressive powers men had over their women in India. However, the story â€Å"The conscience of the court,† brings out the theme of loyalty and devotion, but at the same time brings out the theme of, human relationship, oppressive human behavior, and desire of men to mistreat women in the society. This is different from ‘punishment’ because the black domestic worker was loyal to her master in contrast to the case whereby the two wives did not show loyalty to their husbands. Lee, the domestic worker stands out of her limit to protect her master’s, Miss Clairborne, property despite having a loan to the white man. â€Å"I am an unlearnt woman and common-clad†¦Ã¢â‚¬ (Hurston 102) indicate that Lee had few opportunities to pay the loan. However, Beasley the owed white man by Lee was determined to oppress Lee further by confiscating her employee property that would have rendered her jobless. Lee makes a sacrifice that no other woman would do to protect the property by confronting the man out of the loyalty she has for her master and she states, â€Å"I love her so hard, and I can’t help myself† â€Å"(Dabritz 112). Setting Both the stories are set on a close human relationship background whereby the story by Hurston involves a domestic worker and her master and that of Tagore entails a family. The story â€Å"punishment† is set in in an Indian village to depict the Indian culture. Indian women have less power in the society whereby men have a history of oppressing them because of their culture. The story is set on family background to put out the theme of women oppression by the culture and the injustices that Indian women face in courts despite being innocent. The context reveals the approaches that the society should take to incorporate western practices and principles without dissolving the Indian cultur

Causes and Effects of the American Civil War Essay -- American History

Ã‚  Ã‚  Ã‚  Ã‚  Did you know that in the Civil War, America lost the most men ever? After four years and over 600,000 American lives, the Union (North) prevailed in wearing down and forcing the Confederacy (South) to surrender. Eli Whitney’s cotton gin, the Missouri Compromise, and the Dred Scott case contributed greatly to the Civil War. After the Civil War, the Southern economy was devastated with millions of homeless, while the northern economy boomed.   Ã‚  Ã‚  Ã‚  Ã‚  Eli Whitney created one of the first causes of the Civil. In 1793 Eli Whitney’s invention of the cotton gin greatly increased the amount of cotton produced. The cotton gin cleaned the cotton by extracting the cottonseeds efficiently. In the 1800’s, 36,000 bales of cotton were exported, but after the invention of the cotton gin, 4,600,000 bales of cotton were produced. This could not be done with out the help of slave labor. Slave labor allowed the production of cotton to be profitable and the southern farms relied on slaves because they couldn’t plant and harvest more cotton without them. The southern economy grew dependent on slave labor and some areas of the south consisted of over 50% slaves.   Ã‚  Ã‚  Ã‚  Ã‚  As the tensions grew, the battle for free or slave states intensified. The Missouri Comprise decided whether Missouri would be admitted into the union as a state that would allow or prohibit slavery. This issue is due to the fact that Missouri doesn’t lie on either side of the Ohio River. As of 1819 any states south of the Ohio R...

Halting the wheels of hope Essay

The concept of governmental tyranny is often difficult to grasp to those living in more democratic nations, and media output and literature become key in growing to understand it’s implications. Serving to heighten this political perspective is â€Å"The Wheels of Freedom: Bicycles in China† by Fred Strebeigh, which describes China’s bicycle ban in 1989 and subsequent protests in Tiananmen Square, Beijing. The bicycle provided significant growth and freedom within Chinese culture, and Strebeigh endeavors to communicate this to readers. Illustrating this, he defends the will of the people to preserve their right to ride them in the face of government opposition, and the tragedy imposed by political oppression. Upon the bicycle’s introduction to the people of China in the early 20th century, many looked to it through eyes of bewilderment. A fascinating and not yet popularized machine, it was most commonly ridden by members of affluent societies. As it’s newness wore off, however, it slowly became available those of the more humble classes, and in place of the word â€Å"bicycle†, the term â€Å"foreign horse† found it’s use in the minds and mouths of the masses. Strebeigh includes that the term â€Å"foreign† communicated the people’s feelings of admiration for the bicycle while alluding to the fact that it was modern. The peasantry of China found themselves with the deepest sense of admiration for the â€Å"foreign horse†. To them, the thought of owning one brought to mind the ease it could bring to their everyday lives, as they often carried burdensome loads on their backs. Yet, the low supply and thus high cost of the bicycle made it’s acquisition impractical for them. In response to the desire, the government later began regulating higher production rates of the bicycle to readily supply them to the impoverished and raise morale. However, the term â€Å"foreign horse† was banned in light of it’s glorification of another nation’s ingenuity, highlighting the extremes of the Chinese government to exercise their sovereign of the people. In it’s place, the name â€Å"self-running cart†. This served to express the government sentiment that the people could have what they wanted, but only at it’somplete jurisdiction. The people tolerated the name change of their beloved bicycles, as the trade-off of name for it’s widespread distribution was easy enough, and many still used it’s original moniker in private. Following it’s popularization, the lives of many saw an enrichment in quality. The dignity of the people improved, as it granted them new freedoms and eased the stress of everyday tasks, al lowing for flourishing business and connectedness within communities. Perhaps stated best, Strebeigh wrote of it’s wide use, â€Å"Everywhere, cycles kept life rolling† (Strebeigh). In addition to heightening the commerce of societies, it introduced the occupation of bicycle repair, which Stebeigh revered as perhaps the â€Å"freest† job in China. In it’s praise, he wrote, â€Å"A hard worker needed only a street corner and a few tools. Before his eyes bikes would inevitably break down and, if he was skilled, clients would multiply. Bicycle repair seemed to offer an extension of what the bike itself offered and what so many Chinese sought: modest dignity, new choices, ample freedom. † (Strebeigh). Bike repair was a choice outside of the typical, and entirely pursued as an individual pleased. Sadly, it was the bicycles issuance of dignity, choices, and freedom that that ultimately inflicted threat upon the Chinese government. They understood that with bike ownership, the people were growing to a height of advantage. It was their supposition that, if the people continued in such a fashion, government control perhaps had the potential to become menial. To ensure that their ultimate authority was not being overlooked, a ban was placed on bicycles within China. News of this did not come amicably to the people, and their response was protest. It was Tianenmen Square in Bejing which saw the organization of a large-scale demonstration which rallied for government reform. It lasted weeks, and ended upon the mobilization of troops to the area. Their invasion was destructive and resulted in the loss of many lives as troops initiated the use of tanks and weaponry to control the people. In media coverage, it was not the bloodied bodies of victims that were aired on television screens in Chinese homes, but rather the depiction of bicycles which had been crushed by the military. Of it, Strebeigh writes, â€Å"They wanted to show crushed dignity, crushed humanity, crushed freedom–so much that the bicycle means in China. † (Strebeigh). This image was a wise devise of the government. They knew what the bicycle represented to the people, and knew that to show it destroyed would communicate their dominance and triumph. The concept of tyrannical rule and its implied bleakness are often incomprehensible, or altogether unrecognized by the people of more democratic countries given their many freedoms. With the words of Fred Strebeigh, however, perspective expands. The honor of an object as seemingly simple as a bicycle becomes worthy of defense, even dying for, and the tragedy of oppressive rule becomes very real. Works Cited
